Dovel & Luner Sues Nectar for Advertising Fake Sales

SANTA MONICA – Dovel & Luner, a boutique litigation law firm, on Wednesday filed a class action lawsuit against Nectar Brand LLC on behalf of California consumers who purchased Nectar mattresses and bedding online.  The lawsuit alleges that Nectar creates an illusion of discounts by using fake regular prices, fake discounts, and fake limited-time offers to mislead and overcharge consumers.

The Complaint, filed in the Superior Court of the State of California – County of Los Angeles, alleges that Nectar violated the consumer protection laws of California, including California’s Unfair Competition Law and False Advertising Law, and the Consumer Legal Remedies act.

According to the lawsuit, “While there is nothing wrong with a legitimate sale, a fake one—that is, one with made up regular prices, made up discounts, and made up expirations—is deceptive and illegal.”

The complaint states, “Nectar’s products do not retail at the supposed regular prices it lists. In fact, Nectar has never once sold a single product at its supposed ‘regular’ price. The supposedly ‘discounted’ prices are the prices that Nectar always sells its products for.” 

“Nectar’s practice of intentionally misrepresenting the actual prices of its products to deceive consumers is unfair and misleading,” said Christin Cho of Dovel & Luner.  “Plaintiffs brought this case to protect the thousands of California consumers who purchased Nectar’s products under false pretenses.”
