Dovel & Luner Sues RugsUSA for Advertising Fake Sales
SANTA MONICA – Dovel & Luner, a litigation boutique law firm, on Friday filed a federal class action lawsuit against RugsUSA, LLC on behalf of consumers nationwide who purchased products from Rugs USA online. The lawsuit alleges that Rugs USA creates an illusion of discounts by using fake regular prices, fake discounts, and fake limited-time offers to mislead and overcharge consumers.
The Complaint, filed in the United States District Court of Central California, alleges that Rugs USA violated the consumer protection laws of California, including California’s Unfair Competition Law and False Advertising Law, and the Consumer Legal Remedies act.
According to the lawsuit, “[w]hile there is nothing wrong with a legitimate sale, a fake one—that is, one with made-up regular prices, made-up discounts, and made-up expirations—is deceptive and illegal.”
The complaint alleges, Rugs USA’s “advertisements are false. [Rugs USA] always offers sitewide discounts, so it never sells any of its Products at the purported regular price. The sales are not limited in time, but instead immediately reset and continue to be available.”
“The practice of intentionally misrepresenting the actual prices of products to deceive consumers is unfair and misleading,” said Christin Cho of Dovel & Luner. “Plaintiff brought this case to protect the thousands of U.S. consumers who purchased Rugs USA’s products.”
