Dovel & Luner Sues Global Custom Commerce for Advertising Fake Sales
SANTA MONICA – On January 26, 2023, Dovel & Luner LLP filed a federal class action lawsuit against Global Custom Commerce, Inc. (GCC) on behalf of U.S. consumers who purchased products from GCC’s websites (Blinds.com, JustBlinds.com, and AmericanBlinds.com). The lawsuit alleges that GCC creates an illusion of discounts by using fake regular prices, fake discounts, and fake limited-time offers to mislead and overcharge consumers.
The Complaint, filed in the United States District Court of Southern California, alleges that GCC violated the consumer protection laws of California, including California’s Unfair Competition Law and False Advertising Law, and the Consumer Legal Remedies act.
According to the lawsuit, “While there is nothing wrong with a legitimate sale, a fake one—that is, one with made-up regular prices, made-up discounts, and made-up expirations—is deceptive and illegal.”
The complaint states “[GCC]’s sales are not limited in time, and the discounts continue to be available … [GCC]’s published regular prices were not the prevailing regular prices.”
“The practice of misrepresenting actual prices to deceive consumers is unfair and misleading,” said Christin Cho of Dovel & Luner. “Plaintiffs brought this case to protect the thousands of U.S. consumers who purchased Global Custom Commerce’s products.”
