The California FAIR Plan

Are you a Palisades or Eaton Fire victim, struggling to receive fair compensation from your California FAIR Plan insurance policy?

In January 2025, both the Palisades Fire and the Eaton Fire ignited and spread throughout the Pacific Palisades and Altadena areas of Los Angeles County.  Both of these fires have become some of the most destructive and devastating fires in California history.  These fires resulted in 30 confirmed civilian fatalities, destroyed thousands of homes, and forced the evacuation and relocation of countless residents.

California’s wildfire season is now essentially year-round, which has led various insurance companies to withdraw or reduce coverage in certain areas of the state.

As a result, more Californians are turning to the California FAIR Plan, established in 1968 “to meet the needs of California homeowners unable to find insurance in the traditional marketplace.”  The FAIR Plan “provides basic fire insurance coverage for high-risk properties when traditional insurance companies will not.”

According to their website, the FAIR Plan promises to provide “access to basic property coverage when it’s needed, ensuring that all Californians, including those who live in areas threatened by wildfire, have access to the fire coverage and the peace of mind they deserve.”

The FAIR Plan, however, has not kept its promise for those affected by the Palisades and Eaton Fires.  Policy holders are being underpaid or outright denied coverage for damages caused to their homes, especially when the claim is based on smoke damage.

How Dovel & Luner can help

As a firm based in the Los Angeles area and impacted by the recent fires ourselves, we are here to help those impacted by the Palisades and Eaton Fires understand their legal rights.

We empathize with the challenges faced by those affected by wildfires in California, including the disruption of lives and devastating losses of homes and property.  If you or someone you know have been affected, you do not have to face the process of recovery alone.

Dovel & Luner is investigating claims based on denial and underpayment from the FAIR Plan and intends to pursue litigation.  We can work with you to make sure that insurance companies keep their promises to compensate victims of these fires.

If you or a loved one is a FAIR Plan policy owner and suffered property damage, you may have a claim for damages and insurance coverage.
